The federal appeals court has maintained a prohibition on deploying state troops in Portland, Oregon, following a recent legal decision.

Appeals Court Concurs to Reconsider Case

The federal appeals court ruled on this week that it would reexamine the case concerning the executive power with an larger group of 11 judges. The court also overturned a previous ruling from a three-judge panel that had supported the federal government.

Ongoing Dispute Over Troop Deployment

This order represents the most recent turn in a long-running legal battle over whether the administration has the authority and valid reason to deploy state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in due to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that federal officials at the ICE facility in the southern part of the city were facing threats, while city and state officials maintain that local officers have control of the circumstances.

In defiance of descriptions of Portland as “war ravaged”, locals have been posting videos of scenic paths and a vibrant culinary culture, and planning activities such as an protest bicycle event against the “militarization of our city”.

Court Proceedings

The Tuesday ruling came after a federal judge in the city enacted two temporary restraining orders this period – one preventing the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in Oregon, after efforts to circumvent the first order by mobilizing troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing command of 200 Oregon national guard – but the subsequent injunction remained in place, preventing the physical sending of the forces.

Full Panel Consideration

The Tuesday decision means the issue will be heard “en banc” – with all decisions under review together – by a group of 11 judges.

“This ruling demonstrates that the truth matters and that the courts are working to ensure government responsibility. The founding document limits the president’s power, and Oregon’s communities cannot be treated as a training ground for unchecked federal authority,” said the state attorney general in a statement.

“The court is sending a clear message: the executive leader cannot dispatch the military into US cities without cause. We will continue defending Oregon’s laws, values, and autonomy as this case moves forward and our fight continues in the courts.”
